1. Acknowledgment of Risks
I, the undersigned participant, acknowledge that I am aware of the inherent risks and dangers associated with aviation activities, including but not limited to flight training, aircraft operations, and related ground activities. I understand that these activities involve risks that may result in serious injury, death, or property damage.
2. Specific Risks Acknowledged
I specifically acknowledge and understand the following risks:
- Aircraft Accidents: Risk of aircraft accidents, crashes, or incidents during flight operations
- Weather Conditions: Risks associated with adverse weather conditions, turbulence, and atmospheric phenomena
- Mechanical Failures: Potential for aircraft mechanical failures or malfunctions
- Human Error: Risks associated with pilot error, instructor error, or other human factors
- Emergency Situations: Possibility of emergency landings, forced landings, or other emergency procedures
- Ground Operations: Risks during aircraft movement on the ground, including taxiing and parking
- Altitude and Pressure: Risks associated with changes in altitude and atmospheric pressure
- Medical Issues: Potential for medical emergencies during flight operations
3. Assumption of Risk
I voluntarily assume all risks associated with participation in flight training activities, including the risk of serious injury, death, or property damage. I understand that these risks cannot be eliminated and are inherent to aviation activities.
4. Release and Waiver of Liability
In consideration of being permitted to participate in flight training activities with FlyHigh Aviation School, I hereby release, waive, discharge, and covenant not to sue FlyHigh Aviation School, its officers, directors, employees, agents, instructors, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property, whether caused by the negligence of the Released Parties or otherwise, while participating in flight training activities.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, costs, expenses, and attorney fees arising out of or related to my participation in flight training activities, including but not limited to claims brought by third parties.
6. Medical and Physical Condition
I represent and warrant that:
- I am in good physical and mental health
- I have no medical conditions that would prevent safe participation in flight training
- I have disclosed all relevant medical information to the flight school
- I will immediately notify the flight school of any changes in my medical condition
- I will not participate in flight activities if I am under the influence of drugs or alcohol
- I will comply with all medical certificate requirements
7. Compliance with Rules and Regulations
I agree to:
- Comply with all Federal Aviation Regulations (FARs)
- Follow all flight school rules, procedures, and instructions
- Obey all instructor directions and safety procedures
- Maintain required licenses, ratings, and medical certificates
- Report any safety concerns or incidents immediately
- Use proper safety equipment as required
8. Insurance Acknowledgment
I understand that:
- FlyHigh Aviation School maintains aircraft insurance coverage
- This insurance may not cover all potential losses or damages
- I am responsible for my own personal injury and property damage insurance
- Insurance coverage does not affect the validity of this waiver
- I should consult with my insurance provider regarding coverage
9. Emergency Medical Treatment
In the event of an emergency, I authorize FlyHigh Aviation School and its representatives to:
- Seek emergency medical treatment on my behalf
- Contact emergency services and medical personnel
- Provide relevant medical information to healthcare providers
- Contact my emergency contacts as provided
- Make decisions regarding my medical care if I am unable to do so
10. Photography and Media Release
I grant FlyHigh Aviation School permission to:
- Take photographs and video recordings during training activities
- Use such media for promotional and educational purposes
- Publish images and videos on the school's website and social media
- Use my name and likeness in connection with such media
- I understand I may withdraw this consent at any time in writing
11. Severability
If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. This waiver shall be construed broadly to provide maximum protection to the Released Parties.
12. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the state in which FlyHigh Aviation School is located. Any disputes arising from this waiver shall be resolved in the courts of that jurisdiction.
13. Entire Agreement
This waiver constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements, understandings, and representations, whether oral or written.
14. Acknowledgment of Understanding
I acknowledge that:
- I have read this waiver carefully and understand its terms
- I have had the opportunity to ask questions and seek clarification
- I am signing this waiver voluntarily and of my own free will
- I understand that this waiver is legally binding
- I am at least 18 years old or have parental/guardian consent
- I will not participate in flight activities without signing this waiver
